Thank you for your further letter of 30 September

Yes, I agree that we should cut through the “turgid interpretation of process and legislation” (your words) that has characterised this correspondence.

First, I can say that I have been on the Abel Tasman track when some 40 runners went past. I did not find it offensive because I knew that I might encounter runners and I had set out on the track with that knowledge. I also knew that it was an annual event so that if I wanted to avoid sharing the track with runners I could have picked another day. Even if a larger number had gone past, the principles are the same. That is how I see it. Different people, however, will have different responses to encountering runners on a tramping track. The important thing in my view is having the knowledge so that an informed choice can be made, and expectations adjusted accordingly.

Second, the Routeburn run was applied for and approved as a one off event. If it is to become more than a one off event, it will be publicly notified as a new concession proposal. The Department will make sure that the legislation and the principles of natural justice are followed, including making all material information available upon request to submitters and the applicant for their comment. The Otago Conservation Board will be consulted. The various views will then be considered.

While I expressed the personal view that the 149 postcards were not likely to be representative of the public I was not decision-maker in this matter. My views are therefore not relevant to the decision. I understand that the decision to allow the proposal was based on the fact that one-off sporting events are allowed in terms of the Park plan and that the adverse effects of such an event held outside the track peak season were considered to be minor.

I enclose a copy of the "Routeburn Rage" Social Impact Report which should have accompanied my previous letter to you. If the concessionaire applies again, you will have an opportunity during the process to comment on this report and the weight (if any) that the decision-makers give to it.
